British fast-fashion retailer Boohoo has been fined €2.3 million ($2.47 million) by France's consumer protection agency for engaging in deceptive commercial practices. The penalty, announced this week by the Directorate-General for Competition, Consumer Affairs and Fraud Control, follows an investigation into the company's pricing strategies and product labeling that took place between October 2023 and February 2024.

Investigators found that a significant portion of Boohoo's promotional activities lacked genuine price reductions. Specifically, 40 percent of the promotions examined were deemed to be without true discounts. Furthermore, the agency identified that 48 percent of tracked items saw their prices increase during periods advertised as sales events. These findings highlight a systematic issue with how discounts were presented to consumers.

Misleading Product Descriptions

Beyond pricing issues, the French regulator also cited Boohoo for violating national labeling regulations. The company was found to have marketed certain products made from synthetic materials as genuine leather or suede. This misrepresentation in product descriptions could mislead consumers about the composition and quality of the items they were purchasing, potentially violating consumer trust and fair trade practices.

This recent regulatory action in France echoes similar legal challenges Boohoo has faced internationally. In the United States, the company settled a $100 million class-action lawsuit that made comparable allegations regarding sham sales designed to influence consumer behavior. Boohoo reached that settlement without admitting liability, but the recurrence of such issues across different jurisdictions suggests a pattern in its commercial approach.

Company's Response and Market Pressures

Management at Boohoo indicated that the practices identified by the French regulator pertain to a period when the company was under previous leadership, specifically from October 2023 to February 2024. The firm has stated that these issues have since been addressed and affirmed its commitment to cooperating with ongoing regulatory reviews. Boohoo also pledged to revise its pricing and labeling practices to ensure compliance with consumer protection laws.

The Manchester-based retailer is currently navigating a challenging economic environment, facing intense competition from other low-cost international fashion brands and contending with rising operational expenses. Operating under the Debenhams Group parent entity, Boohoo is working to stabilize its market position amidst declining sales figures and internal restructuring efforts, making this regulatory fine an additional financial strain.
