The ruling means BHP will remain a defendant in a class action lawsuit brought by approximately 700,000 Brazilian claimants. The lawsuit seeks compensation for the November 2015 collapse of the Fundão tailings dam, which released 60 million cubic meters of toxic sludge, killing 19 people and devastating communities and the environment along the Doce River.
BHP, through its joint venture Samarco Mineração S.A. with Vale S.A., has consistently argued that the case should be heard in Brazil. The UK court's decision solidifies the legal pathway for claimants to pursue damages through the English legal system, potentially accelerating compensation efforts for those affected by the incident.
