US Department of Homeland Security Clarifies Deportation Authority for DED Recipients

The United States Department of Homeland Security has confirmed that individuals granted protection under the Deferred Enforced Departure (DED) program remain subject to potential removal proceedings. Officials stated that temporary administrative designations do not confer legal immigration status, nor do they provide immunity from deportation.
This clarification follows reports that approximately one dozen Hong Kong residents enrolled in the DED program were detained by Immigration and Customs Enforcement agents at domestic airports. While the department currently maintains a policy of not executing removals for these individuals, the legal framework allows for the initiation of deportation proceedings at the discretion of authorities.
Work authorization and pending applications do not grant permanent residency or legal status under current federal guidelines. This policy stance highlights a potential governance risk for DED recipients, as their continued presence in the country remains contingent upon ongoing administrative discretion rather than statutory protection.
