This authorization contrasts with the Biden administration's approach, which rejected over 26 million applications for flavored vape products to mitigate youth access. The Supreme Court affirmed the FDA's authority to deny marketing applications for products deemed appealing to children in a unanimous decision last year. Reports indicate former President Donald Trump pressured FDA Commissioner Dr. Marty Makary to expedite the approval of these products.
The FDA stated that Glas Inc.'s "device access restriction technology," requiring government-issued ID and smartphone verification for online purchases, alongside marketing restrictions preventing targeting individuals under 21, are sufficient safeguards against underage use. This action follows a period where FDA efforts and public education campaigns during Trump's first term were credited with preventing nearly 450,000 young people from initiating e-cigarette use, according to a study published in the American Journal of Preventive Medicine .
