The study indicates that a substantial majority, approximately 86%, of these digital platforms are not fulfilling their obligations regarding cookie consent and the overall management of user data.
This level of non-compliance significantly exceeds the 54% average observed across the broader internet, pointing to a distinct governance challenge specific to the gambling industry.
Researchers meticulously analyzed 624 individual online gambling platforms to gather their findings. A concerning discovery was that nearly a quarter, precisely 24%, of these platforms offer no functional mechanism for users to disable tracking software. Furthermore, a substantial 66% of the examined websites reportedly commence collecting user data even before explicit consent is provided by the individual.
Questionable Data Collection Tactics
These data collection methods frequently involve the deployment of 'dark patterns.' These manipulative design choices, such as pre-ticked boxes for privacy-intrusive settings or deliberately obscured options for users to decline data collection, are crafted to subtly influence individual choices and bypass genuine consent. Information obtained without proper user permission is subsequently transmitted to external third-party analytics services.
The primary use for this collected data is often for marketing initiatives. Such practices raise serious regulatory concerns, particularly concerning consumer protection. The behavioral data gathered through these means is frequently critical for strategies designed to maintain user engagement and identify specific gambling patterns, which can have significant repercussions for individuals, especially those vulnerable to gambling-related harms.
Regulatory Landscape and Industry Discrepancy

Officials stated that the leading data regulator has achieved a 95% compliance rate among the top 1,000 websites operating within the UK. However, the online gambling industry deviates significantly from this general trend of increased adherence to data protection legislation, highlighting a persistent gap.
