Federal regulators are scrutinizing transactions where Santos allegedly profited from bets related to his own attendance at President Trump's State of the Union address earlier this year.

The Department of Justice (DOJ) and the Commodity Futures Trading Commission (CFTC) have launched probes following a referral from Kalshi, which detected unusual activity in Santos's account. This development marks another legal challenge for the former New York congressman, who was expelled from office in December 2023.

Allegations of Deceptive Trading

Sources with direct knowledge of the trades indicate that Santos made bets on Kalshi predicting he would not attend the State of the Union address, despite publicly stating his intention to be there. He posted a video on social media platform X (formerly Twitter) expressing enthusiasm for his attendance, which reportedly caused market odds to spike.

However, Santos later posted that he was watching the event from an airport, causing the market odds to plummet. Insiders claim he misled the public to gain a financial advantage, allegedly netting tens of thousands of dollars from these deceptive trades.

Regulatory Scrutiny and Santos's Response

Kalshi identified the suspicious trading patterns, subsequently froze Santos's account, and reported the matter to federal authorities. Both the CFTC and the DOJ have initiated formal investigations into these actions. Neither agency, nor Kalshi, has publicly commented on the ongoing probes.

When questioned about the investigation, Santos reportedly expressed surprise, stating, "Well, that's news to me." He also gave a non-committal response regarding his ownership of a Kalshi account and mentioned knowing one of Kalshi's co-founders, Luana Lopes Lara, promising to contact her for clarification. However, he did not follow up.

This investigation into Santos's activities comes at a time when prediction markets like Kalshi are under increased regulatory scrutiny.
