Adidas has commenced legal proceedings in the Federal Court of Australia against online retailer White Fox. The litigation alleges that White Fox’s use of a four-stripe design on apparel constitutes trademark infringement of Adidas’s long-standing three-stripe intellectual property.
The plaintiff contends that the defendant’s design is deceptively similar to its own, creating a risk of consumer confusion. Adidas asserts that White Fox ignored multiple requests to cease the sale and promotion of the disputed merchandise.
Legal counsel for the plaintiff argues that the Legal counsel for the plaintiff argues that the defendant’s branding strategy is intended to capitalize on the established reputation of the sportswear brand. Evidence presented includes promotional material featuring influencers wearing the disputed apparel alongside genuine Adidas footwear.
This action follows a history of enforcement by Adidas regarding its trademark, including a successful 2013 ruling against a separate retailer for similar design infringements. The current case serves as a test of trademark protection for apparel designs within the Australian fast-fashion market.
